GENERAL TERMS AND CONDITIONS TICKETING STADION AMSTERDAM EXPLOITATIE BV
Article 1 Definitions
In this Agreement, the following definitions are used:
General Terms and Conditions
These General Terms and Conditions of Stadion Amsterdam Exploitatie BV (hereinafter ‘Ticketing Johan Cruijff ArenA’);
Buyer
The consumer or company that purchases a Ticket via Ticketing Johan Cruijff ArenA for an Event;
Booking
The conclusion of an agreement whereby the Buyer enters into an agreement with an Organizer of an Event in the manner set out in these General Terms and Conditions
Admission Fees
The price of the ticket, excluding any extra costs or additional supplies;
Event
The event at which – by way of example, but not exclusively – a performance is staged, including – but not limited to – a musical, theatre, stage, or music performance, a concert, show, or a sporting event for which the ticket was purchased;
Location
The place where the Event is held;
Organizer
The party organizing the Event with whom the agreement is concluded upon purchase of the ticket;
Agreement
The relevant Agreement between the Organizer and the Buyer;
Ticket
The admission ticket to an Event;
Website
The website www.johancruijffarena.nl;
Article 2 General
2.1 These General Terms and Conditions apply to all services and offers performed or made through Ticketing Johan Cruijff ArenA, to every Booking for Tickets, whether by telephone, via the websites of Ticketing Johan Cruijff ArenA, or via retail sales. These General Terms and Conditions may only be deviated from in writing.
2.2 The General Terms and Conditions of the Organizer may also apply to the Agreement, which can be downloaded from its website in the relevant case. The location where the Event is held may have house rules and/or rules of conduct, which can be downloaded from its website. By purchasing the Ticket, the Buyer also agrees to these conditions in advance.
Article 3 Formation of Agreement
3.1 Ticketing Johan Cruijff ArenA acts as an intermediary in the formation of the Agreement between the Buyer and the Organizer when offering and selling Tickets. Ticketing Johan Cruijff ArenA is not a party to the Agreement formed by the purchase of a Ticket. The Agreement is formed after the Buyer has placed a Booking for one or more Tickets via Ticketing Johan Cruijff ArenA. Ticketing Johan Cruijff ArenA provides the admission tickets for the relevant event on behalf of the Organizer. The sending of Tickets by Ticketing Johan Cruijff ArenA to the Buyer takes place on behalf of the Organizer.
3.2 Method of formation of the agreement:
The Agreement is formed as soon as the Buyer has placed a Booking. Ticketing Johan Cruijff ArenA may, solely at its discretion, unilaterally dissolve the Agreement on behalf of the Organizer, claim damages, or demand performance, if the Buyer fails to fulfill its obligations under the concluded agreement.
3.3 A Booking is irrevocable for the Buyer. It is not possible for the Buyer to make changes regarding concluded Agreements.
Article 4 Tickets
4.1 Tickets can be booked by a Buyer via the Website of Ticketing Johan Cruijff ArenA
4.2 The Tickets provided by Ticketing Johan Cruijff ArenA are and remain the property of the Organizer and are made available to the Buyer by Ticketing Johan Cruijff ArenA.
4.3 It is not permitted, without prior written consent from the Organizer and/or Ticketing Johan Cruijff ArenA:
i. To sell the Tickets to third parties or to provide the Tickets to third parties directly or indirectly in any other commercial manner;
ii. To offer the Tickets in commercial communications – in any manner whatsoever – or to refer to the admission tickets in any other way;
4.4 If the Buyer acts in any way contrary to the General Terms and Conditions of Ticketing Johan Cruijff ArenA or the Organizer, Ticketing Johan Cruijff ArenA and/or the Organizer may invalidate the Tickets; holders of such Tickets will be denied access to the Event in the case in question, without entitlement to compensation.
4.5 Ticketing Johan Cruijff ArenA and/or the Organizer reserve the right to set a maximum limit on the number of Tickets that can be booked. Bookings exceeding this maximum may be adjusted / cancelled without prior notice.
4.6 The prices for Tickets may be higher than the prices printed on the Tickets by Ticketing Johan Cruijff ArenA due to possible additional costs for, for example, reservation, payment and/or delivery. The statutory VAT rates apply.
4.7 The additional booking fees may deviate based on the method and time of purchase. All costs are shown at the Booking. No costs other than those shown will be charged.
4.8 Tickets only grant access to the booked Event if the Ticket is provided with the control strip.
Article 5 Fulfillment
5.1 Ticketing Johan Cruijff ArenA aims to send the Tickets to the Buyer before the start of the Event, but at least 7 days before the start of the Event, provided that the purchase price for the Tickets has been paid. If the Tickets are not received by the Buyer in time, the Buyer must contact Ticketing Johan Cruijff ArenA in writing (by letter or e-mail).
5.2 Upon receipt of the ordered Tickets, these must be checked by the Buyer for accuracy. In the event of incorrectly printed Tickets, the Buyer will receive replacement Tickets upon first written request and without additional costs, provided that the Buyer returns the tickets already delivered to Ticketing Johan Cruijff ArenA. Such a request must contain the relevant details and reasons. If the customer has not informed Ticketing Johan Cruijff ArenA in writing within 7 days prior to the start of the event, Ticketing Johan Cruijff ArenA may decide not to exchange the Tickets.
5.3 Ticketing Johan Cruijff ArenA reserves the right at all times to refuse Bookings from Buyers or to impose additional conditions on Bookings.
Article 6 Liability
6.1 Ticketing Johan Cruijff ArenA cannot be considered the Organizer of the Event and is not responsible for, nor does it provide any guarantee regarding, the (artistic) quality and content of the Event and the course of events in or around the Venue, and accepts no liability whatsoever on this basis.
6.2 If and to the extent that the Event is cancelled by the Organizer or the Venue Holder, Ticketing Johan Cruijff ArenA shall never independently proceed to refund Ticket Fees to the Buyer. It may occur that an Organizer requests Ticketing Johan Cruijff ArenA to proceed with a refund, in which case Ticketing Johan Cruijff ArenA again acts solely as an intermediary on behalf of the Organizer.
6.3 Ticketing Johan Cruijff ArenA can never be held liable for any damage suffered by the Buyer as a result of death, injury, accidents, harm, loss, damage, or theft prior to, during, or as a result of a visit to the Event or the Location.
6.4 If and to the extent that Ticketing Johan Cruijff ArenA is wholly or partially unable to fulfill its obligations towards the Buyer due to force majeure, the Buyer cannot derive any right to compensation therefrom.
6.5 Ticketing Johan Cruijff ArenA accepts no liability whatsoever for loss or damage to Tickets by the Buyer for any reason whatsoever. In the event that Ticketing Johan Cruijff ArenA is requested by the Buyer to provide replacement Tickets, Ticketing Johan Cruijff ArenA is entitled to charge costs for this.
6.6 To the extent that the liability of Ticketing Johan Cruijff ArenA is excluded or limited, this also applies to the liability of the subordinates and/or auxiliary persons of Ticketing Johan Cruijff ArenA.
